ABOUT DAVIES & DAVIES

Nigel Davies BSc (Hons) (Q.Surv), GDipLaw, PGDipLP, DipArb, FRICS, FCIOB, MInstCES, FCIArb, FFB, is a Chartered Surveyor, Chartered Builder, Chartered Arbitrator, Solicitor Advocate, Panel Registered Adjudicator, Mediator and Mediation Advocate.
Nigel originally launched the business in 2005, and upon incorporation at the beginning of 2008, it changed its name to Davies & Davies Associates Ltd. Davies & Davies has steadily grown year on year, providing quality comprehensive advice and support to organisations in the construction industry involved in difficult projects, high risk/reward contracts, disputes and conflict. The launch of the central London office established the business’ physical presence in the nation’s capital.
As both a Chartered Quantity Surveyor and Solicitor Advocate, having worked for building contractors in the construction industry and law firms in the field of construction law, Nigel offers an unusual perspective gained through his hands-on experience which he continues to maintain.
Nigel is conversant with the standard forms of contract and sub-contract currently in use in the building and civil engineering industries together with the associated methods of measurement. Nigel also undertakes the vetting and drafting of contracts, seminars, provision of legal advice, Mediation services and the overseeing of all aspects of dispute resolution including Litigation. He is experienced in the resolution of both simple and complex contractual problems.
Not only does Nigel undertake appointments as an Adjudicator, he is a Chartered Arbitrator and a Mediator, who also represents clients across a variety of contentious and non-contentious construction matters - details of which can be found under client examples on the our Services section. In addition, Nigel is a member of the RICS Construction and Dispute Resolution Faculties, The Law Society, the Chartered Institute of Building, the Institution of Civil Engineering Surveyors, The Faculty of Building and a Fellow of the Chartered Institute of Arbitrators. He is also a practising Adjudicator panel registered with the RICS and the CIC, a Mediator and a Mediation Advocate.

Matthew Davies Bsc (Hons) Quantity Surveying, LLB (Hons), LPC (Commendation), Member of the Royal Institution of Chartered Surveyors, is dual qualified as a Chartered Quantity Surveyor and a Solicitor.
Matthew specialises in providing legal, commercial and contractual management, construction claims and dispute resolution services to the construction industry including representing organisations in adjudication and other dispute forums. Matthew also drafts and reviews contracts, sub-contracts and collateral warranties, and advises on a variety of contentious and non-contentious construction matters. He also undertakes the preparation and resolution of complex final accounts and other quantity surveying matters.
Matthew has over 16 years experience in the construction industry originally gained working as a quantity surveyor working on a variety of building projects, then latterly as a consultant and a solicitor specialising in commercial and contractual management and construction law. During this period Matthew has worked and acted for employers, architects, main contractors and specialist sub-contractors in providing quantity surveying, legal and commercial services on a wide range of construction projects operating under a variety of standard and non-standard contracts and sub-contracts. These have included: shopping centres, commercial offices, leisure centres, underground station, industrial facilities, shopping centres, refurbishment, prestige residential developments and social housing.
Matthew also undertakes the vetting and drafting of contracts, seminars, provision of legal advice and the overseeing of all aspects of dispute resolution including Litigation. He is experienced in the resolution of both simple and complex contractual problems.
In addition to the above Matthew is the joint author of the book “Subcontracting under the JCT2005 forms”.

Lawrence Rogers, FRICS, FCIArb, FCIOB, MaPS.
Lawrence Rogers is a Consultant Quantity Surveyor to Davies and Davies Associates Ltd with 46 years' experience of quantity surveying including professional work, acting for building/civil engineering contractors and sub-contractors, legal services’ support, expert witness appointments in litigation and arbitration, and instructing counsel in an arbitration hearing.
He has worked on behalf of public and private employers, large and small contractors, sub-contractors and speculative developers, and as the general manager of a small building firm.
Well-known projects over the last decade have included acting for the client for the zones inside the Millennium Dome, being part of the main contractor’s legal support team at Wembley Stadium, acting for the sportsfield contractor which rebuilt the track and irrigation systems at Ascot Racecourse and the construction of the Football Association’s new training academy near Burton-upon-Trent.
Lawrence has advised on contract documentation for repairs to the Victoria Line and preparing claims for specification and operating changes.
Lawrence has also undertaken contentious final accounts and general dispute work, including ascertaining the issues and preparing evidence in connection with a litigious dispute concerning a National Laboratory.
He was also appointed the project manager for a rebuild project following internationally publicised damage to a Grade 2 Listed pub, a prominent entry in the National Inventory of Pub Interiors of Outstanding Historic Interest.
The many projects with which he has been involved have included restoration and renovation of listed buildings including houses, a causeway and barristers’ chambers.
Lawrence has also received several appointments as planning supervisor (now CDM-C) from the inception of the first regulations in 1994.

Trevor Upright is a Consultant Quantity Surveyor to Davies & Davies Associates Ltd with 23 years extensive experience in Residential development and Commercial construction projects ranging from Social Sector Housing to prestigious residential developments, both low and high rise. This has provided him with the necessary insights to ensure projects are completed to the highest standards and within client’s budget.
Trevor's experience includes working on the Athletes Olympic Village as a Senior Commercial Manager with Bovis Lendlease project value circa £130m; working with Lovell Partnerships London Division on various Partnering Contracts up to values of circa £50m; involvement with Decent Home Projects; and Social Housing schemes in the London Boroughs of Hackney, Barking and Dagenham, Camden, Islington (Barnsbury), plus The City of Westminster (Regents Park) and Colchester.
In addition his experience has been broadened with clients such as Galliford Try (Stamford Homes) as well as smaller surveying practices. This has given Trevor the ability to manage all aspects of surveying and commercial management including estimating, feasibility studies, tender prequalification, analysis, claims, verification plans and recommending preferred contractors.
He has significant experience in the preparation of enquiry tender documents, cost plan analysis, monthly reporting, cash flow, change controls, and final accounts, both client and trade related. Unsurprisingly he has simultaneously liaised with design teams to ensure procurement timescales for both tender documentation and contract information are received to meet programme timescales.

Stephen Lynch is a Consultant Quantity Surveyor to Davies & Davies Associates Ltd with over 6 years experience providing quantity surveying services to main contractors. His experience includes a variety of sectors running the commercial aspect of projects with values up to £5m. His most recent projects have involved providing pre and post contract surveying services on new build and structural residential refurbishments, fast-track retail fit-out projects and a prestigious museum project.
Stephen specialises in providing the full range of services including rapid procurement, sub-contract engagement, final account settlement and the preparation and administration of both extensions of time and loss & expense.
He has had articles published in property magazines commenting on market conditions and excels in client and sub-contractor communication.

LLB (Hons), LPC (Commendation) is a Trainee Solicitor with experience as an Assistant Quantity Surveyor.
Alex is a Trainee Solicitor with Davies & Davies Associates Ltd who graduated from the University of Sussex in 2007 with an LLB Honours degree in Law and became an Assistant Contracts Surveyor with a City based contractor, during which he worked on multiple projects using a variety of construction contracts, including:
- The construction of 13 new residential apartments in Bethnal Green with a final value of circa £1.5 million operating under the JCT Standard Form of Building Contract with Contractor’s Design;
- Demolition, asbestos removal and site clearance works to enable the construction of 10 new build houses in Highbury with a final value of circa £100k operating under a letter of intent;
- The construction of a 16 room boutique hotel with a basement restaurant, ground floor retail space and rooftop bar in Shoreditch with a final account submission of circa £8.8 million;
- The refurbishment of a primary school in Stockwell including a new swimming pool and three storey extension block with a contract value of circa £3.25 million operating under the JCT Standard Form of Building Contract with Quantities 2007;
- Procurement and drafting of Sub-Contract Agreements for a project in Newham operating under a Building Schools for the Future (BSF) D&B Building Contract (Target Cost Option)
Whilst working as an Assistant Contracts Surveyor Alex completed his Legal Practice Course (LPC) on a part time basis, attending the BPP Law School in Waterloo and gaining a commendation.
Alex has been a Trainee Solicitor with Davies and Davies Associates Ltd since August 2009. He is comfortable dealing with all aspects of construction law, both contentious and non contentious, having assisted Matthew and Nigel Davies on a range of matters including Adjudication, Litigation, Enforcement, Negotiation and Contract Drafting.
Alex's understanding and application of construction law reflects both his grounding and experience within the construction industry as a quantity surveyor and latterly, as a trainee solicitor specialising in construction law and dispute resolution.
Alex will qualify as a solicitor in February 2012

Robert Sliwinski, BSc LLB (Hons) FRICS FCIArb, FNADR Barrister, Attorney (New York) RICS & CIArb Adjudication Panel Member.
Robert Sliwinski is a Consultant to Davies & Davies Associates Ltd having worked and practised within the Construction Industry and Legal Profession for over 29 years.
Having initially commenced his career as a Quantity Surveyor, in 1988 Robert became involved with dispute resolution in the Construction Industry and between 1990 - 2000 practised as a barrister at the Bar of England and Wales. During this time Robert also began to act as Adjudicator and Arbitrator within the Construction Industry, and has been appointed to the RICS Adjudication Panel and the CIArb Construction Adjudication Panel. He continues to undertake appointments as an Adjudicator and Arbitrator, and also acts on behalf of clients up to and including representation at Adjudication and Arbitration hearings.
Robert also undertakes the vetting and drafting of contracts, seminars, provision of legal advice, Mediation and the overseeing of all aspects of dispute resolution including Litigation. He is experienced in the resolution of both simple and complex contractual problems with knowledge of construction and legal systems both in Europe and America.
